I'm sure most of you saw the picture. Approx 50 feet from the hotel, im in the turn lane goin to the entrance. 2 cars stop to let some old bitch come out of mcdonalds, she clips the front passenger corner. Airbags go off, I make sure kelly (my gf) is ok, get out of the car and damn near **** myself.

http://iceman.draepi.org/brendan.jpg

The cop comes, asks if im ok. I say yes and give him a quick rundown of what happened, no details or anything "she came outta mcdonalds and hit me" type of thing. The ambulance comes, checks us up, were both ok. Next thing I know, IM getting the ****in ticket. imporper lane use....

now the clincher...

I never gave an official statement of what happened, never signed anything, nothing. All I got to do was say "yup she hit me" now heres your ticket. They never even told me where they took my car. They threw it onto the trailer and straight up left.

I totally plan on fighting this :rage:

dude....sorry to hear man. definately fight it. if u know u were in the right, then dont take it, fight it. looks like a little miscommunication from the law to you. they should of informed you where ur car was going, how much, and all that crap. what a crappy situation for you, but hopefully things will get better. instead of fighting the ticket, u should of fought that broad that hit u. lol

UPDATE: Talked to the court today. Found out where my car is, and filed a complaint against the officer with his seargent.

I pretty much explained what happened, and how disappointed i was with how the officer handled the situation. He suggested that I take it to an informal hearing and see if i cant do something about it that way.

I don't understand, were you stopped as well as the other people to let the ol' broad out, or where you driving in the other lane minding your own business?? Either way, you are NOT fault in this. The old lady coming out of the parking lot did not have the right of way, whether people stopped for her or not. If they stopped it was out of courtesy, but she shouldn't have pulled out unless it was all clear.

DumpsterDamon

Brendan that sucked real bad. that lady needs to learn how to drive and that cop needs to be punched. perferrably in the throat.

As I told you at GAP, I drove in that same lane all the way from McDonald's to the hotel. I still don't see how you can be ticketed when you were already in the lane and she was pulling into it. I wouldn't be at all surprised if they threw the ticket out of court, after all she has to yield to traffic already in that lane before she pulls out.

LOL. Did you still have power after the accident?

cavingman
07-27-2003, 07:42 PM
yea, after the bags went off, i let off the brake and realized it was still running. rolled maybe 1 or 2 feet, then put it in park and yanked the key out.

07-27-2003, 11:18 PM
You probably got startled from the bags and threw your hands up and hit the windshield wiper stalk.

Either way man, that was so f-cked up. I was sitting at McDonalds when it happened! My back was turned to them and I was just throwing my bag out in the garbage and jumped into my car. Saw the inside lane was at a dead stop so I pulled into the outside, saw an opening on the inside, jumped in, and saw a black GT coupe with orange accents -- my heart just stopped and I threw it into the middle lane and stopped. Took me a quick second to set in before I actually got out of the car and walked out to Brendan and Kelly. I'm so sorry that that happened bro...I hope everything works out to the best of your benefit. Keep in touch and let us know how things are goin!

thanks for the support everybody. mom and i have been talking with all the insurance people today. kellys trip to the hospital might be covered under us, might not. unclear yet. but the car is on it's way to a chevy dealer to be fixed up.

Brendan....I am sorry this had to happen. Injured orange is never a good thing. I can't really tell from the pics, did the passenger side door ripple?
I hope the underside didn't take too much of a shot.

it was in my 2000 SE. i just got the car and it was the first day me and a few friends actually left school to ditch (we are good kids). we got into an accident where traffic made a path for a car to go through. the car gets hit by an old truck. and the old truck comes flying into my car. i was more worried about my parents finding out we left school lol
these things happen though. let us know what's going on. i hope the best for you and your gf

Ah, that explains it. I thought you were sitting in the lane waiting to turn when you were plowed by the old biotch. So let me see if I have this right. Her intention was to get into the lane that you were coming down on. She came out of Mickey Ds went through a path way drivers made for her and didn't bother to stop to see if a car was coming in the turn lane? Bad move.

Get this...everyone who hasn't heard my story about one of the cops that was there.

This cop came to my house(apartment) in december at 8 in the morning to give me a ticket because the day previously...i suposedly cut him off...on his day off in his personal car.

That guy told me...."oh I never give tickets"....yeah right buddy.

How many times to you have to prove to everyone that you have a penis.....

cavingman
07-30-2003, 09:35 AM
So I'm checking into laws to make sure the ticket shouldnt have been given

check this....

Law #1 (http://198.109.173.11/mileg.asp?page=getObject&objName=mcl-257-642&queryid=4268315&highlight=turn)
more specifically the part that says:
(a) A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from the lane until the driver has first ascertained that the movement can be made with safety. Upon a roadway with 4 or more lanes which provides for 2-way movement of traffic, a vehicle shall be driven within the extreme right-hand lane except when overtaking and passing, but shall not cross the center line of the roadway except where making a left turn.

(b) Upon a roadway which is divided into 3 lanes and provides for 2-way movement of traffic, a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle traveling in the same direction, when the center lane is clear of traffic within a safe distance, or in preparation for a left turn, or where the center lane is at the time allocated exclusively to traffic moving in the same direction the vehicle is proceeding and the allocation is designated by official traffic control devices.

waddya guys think, should i point out the fact that i was getting ready for a turn, and not just cruising in the turn lane?

Slim
07-30-2003, 10:13 AM
