My wife cheating w/a SSG - HELP

I have written proof of sodomy as defined from the UCMJ. My not so soon to be ex wife of 10 years has performed fellatio by her own written admission on a married SSG. I have tried to report him to the MPs but the Sgt of the guard said they would only be able to file a report to his First Sergeant (this is Army) and it was up to the FSG to follow-up on any punitive actions if he so chose to. :banghead Knowing this FSG and SSG there will never be anything done. When I spoke to the lead Sgt of the MP's he said that "This is a kinder gentler Army now and unless it a detriment to the Army's mission, the Army doesn't care anymore." She has slept in his on post house for more than a week now and I tried to get her removed but the MP's said that was a housing issue only.;crap

My questions are this. Do you know of anyone recently, say the past year that has been busted for inter-marital offenses somewhat similar to the above? Should I seek out the JAG and press charges. I want revenge damn it. :banghead

I'm not in the service but damn man i feel for ya i would want revenge to. I would talk to someone higher up but try to keep it on the down low. I wouldn't want everyone knowing i was trying to seek revenge since you are the ex.

Take it through you chain of command if you know that the other soldier's 1SG won't do anything about it. I had a friend that got busted for having sex with another soldier's wife in the same unit. Went from E-4 to E-2. From what I know, it's still taken pretty seriously in some units.

Well it's revenge sure but it's within my legal rights to report illegal activities of military members. Regardless of motive, he broke the law, I should report it. It will just feel really good to watch him get dishonorable discharged and send back to Wyoming.

By the way PhantomLover - I'm ex Marine. No longer have ties to the military. Been out for 7 years now. So I know the codes and laws but I am just really discouraged by what the MP's said.

The MP's said if they both were AD then they would be all over them, but since she's civilian, they don't care.

134 Adultery (maybe) - Very difficult to prove
133 Conduct unbecoming - He used the military e-mail system to contact her during work hours. Im going see if we can get his cell phone records to prove the amount of talk time during military hours he uses. I know they text msg all day long.

If the SSG's FSG won't do anything about it then move up to the unit commander. If he blows you off then speak with the legal office and the IG office on post. If they all blow you off then consider talking to the local press about the lack of concern for the UCMJ on the post. No commander wants to answer for that black eye when it's alot easier to put the offender through the legal wringer before the press gets involved.

Probably a good idea to get a good lawyer on your side at the begining of all this too...

to my knowledge, adultery is not a criminal offense, so a civilian lawyer will be somewhat worthless. as mentioned, it is punishable under UCMJ and since you are not in the military any longer i say screw the chain of command (no pun intended) and go to SJA.

The State of Alaska is a no fault state. The moment I moved out of the house we were legally separated (I wish I had stayed now) so she legally could have moved him in that night. There is nothing legally wrong (morally reprehensible of course) as long as it has no negative effect on the kids. The State only cares about the kids. That is why I want to burn him, because i can't touch her.

The Commander in Chief isn't under the rules of the UCMJ. It's still punishable. it's just whether I'm mad enough to go for it. He has 2 kids of his own, he's trying to do right by his kids, he just got divorced 2 weeks ago. He just got back from Iraq in March. If I screw with him, she will want vengeance on me. I know their relationship will fail eventually. It just hurts right now, watching my boys play at his house more than mine. Watching him hug my soon-to-be ex wife of 10 years.

Anyways yeah the Public Affairs officers hate dealing with legal issues especially UCMJ issues if you start mentioning some bad press their way they will appease and shoot that sucker up the rear with all sorts of UCMJ.
