Are cold air intakes illegal? Can they make you fail an emissions test?

Actually it depends on what state/country you are in. They won't have any real affect on emissions, but some states like California still hold them to emissions rules, and require just about any engine modification you make to have a CARB certification for each part to be legal. A few states like New York follow the same standards set down by California. Other states have a sniffer test, or simply a visual inspection and/or check the computer for active trouble codes. If you will pass or not depends on your states rules and how picky they are. Some state have no emissions testing or inspections at all.

There seems to be a problem with this, the 1st piece that connects with the MAF sensor can't fit because the battery is in the way. Anyone know how to fix this?

Don't know why it wouldn't fit? There is a stock intake tube right there that goes past the battery into the fender. You should be able to fit the tube through that. The opening isn't perfectly round of course, and if the tubing size is too large it might not fit through easily. Some people have had to trim a little sheet metal to get them to fit.
