The lawsuit may include as many as 400,000 GM car owners in Canada, and with each owner claiming Cdn$3,000 ($2,647US) in damages, the claims may total Cdn$1.2 billion, Colin Stevenson, partner at Toronto-based Stevensons LLP, said in a statement today. The suit was filed in Ontario Superior Court in Toronto.

GM used nylon or other plastics in a gasket that seals the cylinder head and engine block to the intake manifold, a part that channels an air-fuel mixture to the engine, the claim said. The seal degrades prematurely, causing coolant to leak into the engine, according to the claim against Detroit-based GM.

"In some cases the engines overheat and seize completely,'' Stevenson said in the statement. "The vehicles often need complete engine replacements at considerable expense to the owners.''

GM introduced a new gasket in 2004, Stevenson said. The company refuses to acknowledge that the earlier product was defective, he said.

Becki Akers, a GM spokeswoman, said she needed to speak with the company's lawyers before commenting on the suit.

The plaintiffs' lawyers, who also include Kirk Baert of Koskie Minsky, are seeking class-action status on behalf of car owners across Canada. Baert was in court today and unavailable for comment, his secretary said. Stevenson didn't immediately respond to a request for comment left on his voice mail.

The suit cites 23 General Motors models as having the defective gasket, including the Buick Park Avenue, which was manufactured from 1995 to 1998 and from 2000 to 2003; the Chevrolet Monte Carlo, made from 1998 to 2003; and the Oldsmobile Alero, produced from 1999 to 2003.

The gaskets also are the subject of an Internet-based recall petition by GM customers and technicians who service GM vehicles.

Shares of GM rose 18 cents to $21.63 at 12:30 p.m. in New York Stock Exchange composite trading.

im gunna call that complain # they have and bitch and see if i take it in if they will pay for the labour (which is the expensive part) since i can get the gaskets for 75 bucks or so.. i dont feel like paying 300-400 bucks in labour

hopefully after GM looses these suits (and most likely they will... do big corporations ever stand a chance?) they'll offer a recall on the gasket.

My LIM gasket is fine right now, but I'd really rather get it replaced before it goes bad. Hell as of now the car's undrivable... which reminds me, spekaing of defective parts, apparently they installed a defective steering rack on my car at the factory because it just snapped on the way to work last monday. How the F*ck does that happen anyway? Anyway I figure after I finally get that repaired (driven my parents old mini-van in the meantime) I'll look into getting that gasket replaced so I never have to go without my car for a long time!

Hate to inform everyone, but class-action lawsuits are pointless. They do nothing but benefit the LAWYERS who try the case. If my memory serves me correct, there has NEVER been a class-action lawsuit that has provided any real monetary benefit for the actual parties.

Gm sent me a letter a week ago saying they recalled the LIM gasket on my car and to take it to the dealearship to get it replaced. But since I had it replaced like a year 1/2 ago they said if I can come up with the recipts they will pay me back. So we will see what happens in a few weeks.

i called the lawyers involved in teh class action suit in the US and they never got back to me. they didnt list the GM thing on their website either.

they wont have a recall if they loose this suit. it will already cost them so much money, its not worth it.

all this class action suit will do is hurt GM for making a huge mistake...i support it.

thats true, typically everyone gets $10 or something. But if GM has to keep payin out money hopefully it'll force a recall.

Recalls are ONLY for problems in the vehicle that can result in injury or death to the passengers or others. The LIM leak CAN NOT do this and has not.

I used the wrong word with recall , on the letter it clearly states that it is no a recall. Didnt think it was that big a deal on the wrong word usage. On a side note they sent me a letter yesterday on the clicking turn signal.

ok then not a recall, but the same type of deal with the turn signals, where if its defective you can get it replaced, otherwise they charge you $40 bucks for looking at it.

I'm not sure what its called, its not called recall, but it pretty much is a recall. After all you can't die from defective turn signals.

But i beg to differ with the lIM gasket. Say all your coolant drains out on the interstate and your engine gets so hot it causes the car to explode! hey I know its far fetched, but it could happen....maybe....ok probably not. But I'm sure you can die somehow from it.
