Exclamation GM Dexcool LIM lawsuit settlement

Couldn't find this here so I posted it for those of you who this may apply to. Good luck to all of you. Taken from another forum.

GM Dexcool Intake Manifold lawsuit settlement

The problems with certain GM engines and the intake manifold deteriorating prematurely may have a court resolution for you if you have paid anything out of warranty for repairs. I was on the Law firm's mailing list and today received an email, which stated the same as this web page:

We are pleased to announce that we have reached a tentative nationwide settlement with General Motors...

You will have the option to be included in the settlement if you incurred out-of-pocket expenses for any of the following repairs:

1. A replacement of the lower intake gasket, made within 7 years or 150,000 miles of the date of initial delivery for 1995-2003.5 Model Year vehicles with 3.1-liter V6 and 3.4-liter V6 engines, where OEM lower intake manifold gasket was a nylon/silicone gasket, and the vehicle was equipped with Dex-Cool coolant.

2. A coolant sealability repair (including, but not limited to, throttle body gasket, upper intake manifold gasket, lower intake manifold gasket, etc.), made within 7 years or 150,000 miles of the date of initial delivery for 1995-2004 Model Year 3.8-liter V6 engines (RPO L36), where the vehicle was equipped with Dex-Cool coolant.

3. A Dex-Cool sludge repair, made within 7 years or 150,000 miles for 1995-2000 Model Year S/T light trucks and sport utility vehicles with 4.3-liter V6 engines and equipped with Dex-Cool coolant.

The settlement will require you to provide proof that you owned or leased the vehicle at the time of the repair and that you paid for an included repair. If you do not have a receipt, ask the auto repair shop that did the work to provide you with one.

The terms of the proposed settlement are confidential while we work to finalize the settlement papers for court approval. If the court preliminarily approves the settlement, the parties will publish, mail, and email a notice that describes the terms of the settlement and your legal rights. We hope to obtain court approval and get notice out by February 2008. At that time, we will be able to answer inquiries regarding the specifics of the settlement and how to file a claim. In the meantime, you should retain all receipts you have for repairs to your vehicle

Not sure if this will cover volutary repairs as in just going in and replacing it if there are no signs or symptoms of LIM failure. But imo it should replace all part suspected in this failure regardless if they have failed or have yet to fail. It's ridiculious it took this long for GM to do anything..and for a lawsuit to have them up off thier butts..thats just the ghey.

Better than nothing..but still not enough. Should be for the life of the vehicle and not 7 years or 150 miles. Ford's LIM dont fail at 175,000. Get with it GM

If you paid for the warrenty repair, as in the deductable, then you should be reimbursed. I will have to double check though.

Also says it has to be within 7 years of the original delivery date ... so it is 150,000 miles or 7 years, which ever comes 1st. But, stewartfn18, I would double check your actual manufacture date ... you may find that it falls with in the guidlines.

I have a 99 GT Coupe that only has 40k on it, and the LIM my be going, but I'm SOL cause it is past the 7 years. I originally thought I just had a bad water pump and a clog in the return line from the radiator to the overflow tank. It also looked like someone had thrown some stop leak in the tank, and I thought that was where the oily residue was coming from in the recovery tank. But now after reading some threads here, I'm wondering if it is not the LIM. I do not have any coolent in the oil though. I've had the car for 2 years and did have to have a lifter replaced last year ... would they have had to take off the LIM to do that?

The 1st month I had it the ALT went out on me. I'm a faily good shade tree mechanic, so I just limped it into the Autozone and barrowed there tools, had the ALT out and in in about 15 min. I decided, while I was buying the ALT, that I might as well change the belt, boy was I surprised to see that you have to take the freaking motor mount off to do that. Man! What freak of and engineer thought that was a good idea!

Any how, sorry to ramble on ... If anyone has an answer to as if the LIM get replaced with they replace a lifter, I would appreciate it.

My LIM showed up as a leak near the t-stat, and an "oil leak" down the side of the pan

The way I read it, is if you payed out of your pocket for any of those repairs done above, then you are coverd only if its before 7 years or 150 clicks. But if your car is lets say 8 years old...but you made the repair within the 7 years/150 clicks, then i believe they should reimburse you for out of pocket expenses durring that time frame but will not cover anything after the 7y/150. That is how i understand it. We will not be sure until the new year when you can actually go and claim it all. I know I def will try.
